CONDITIONS OF USE AGREEMENT FOR THE DISTANCE TURKISH LEARNING CENTER

As used in this Conditions of Use Agreement;

UTOM shall mean the Distance Turkish Learning Center (Uzaktan Türkçe Öğrenim Merkezi);  TOMER shall mean Ankara University Turkish and Foreign Language Research and Application Center (Ankara Üniversitesi Türkçe ve Yabancı Dil Araştırma ve Uygulama Merkezi); COURSE shall mean, in the context of this Agreement, the Turkish Learning Course to be given through the Internet within the framework of distance learning method; PARTICIPANT shall mean the individual who sets a demand to participate in the courses by agreeing to this Agreement; LEVEL shall mean each one of Basic Level (Basic-I, Basic-II, Basic-III), Intermediate Level (Intermediate-I, Intermediate-II, Intermediate-III) and Advanced Level (Advanced-I, Advanced-II, Advanced-III) categories designated by UTOM; PARTICIPATION DOCUMENT shall mean the written document that is presented at the each of each LEVEL to show that PARTICIPANT attended the related COURSE through the Internet; CERTIFICATE shall mean the written document given to PARTICIPANT who has had a right to obtain a PARTICIPATION DOCUMENT and who has taken and received a pass mark at the CERTIFICATE test for the related LEVEL either in one of TOMER branches in Turkey or in a testing center in a country other than Turkey; DIPLOMA shall mean the written document given to PARTICIPANT who has completed the Advanced Level and who has taken and received a pass mark at the DIPLOMA test in one of TOMER branches in Turkey.

In this Agreement, parties concerned are TÖMER and PARTICIPANT.

This Agreement is about the scope and conditions of use for the STOM, and PARTICIPANT agrees to all the terms stated below.

Without limitation, all material, raw and processed content, drawing and design, software programs and source codes, commercial titles, patents, components, passwords, systems, methods, modules, formulas, records and similar products bearing the features of intellectual and industrial property are the shared or individual properties of  TOMER and protected by the Related Laws of Turkish Republic and by applicable International Laws.

Each COURSE is reserved for PARTICIPANT only; the password provided for PARTICIPANT may not be sold or given to third parties and it will be used by PARTICIPANT only. Within COURSE content, the "user name" and any kind of material will be presented to PARTICIPANT for use during COURSE period only on the understanding that PARTICIPANT will be the sole user of this user name and material.
TÖMER reserves the right to terminate PARTICIPANT'S account without refund at its discretion if said user name, password and similar material and related right for use for a limited period of time is sold or given to third party individuals and/or institutions or if any negligence by PARTICIPANT to result in such conditions as to breach the Agreement terms occurs.

PARTICIPANT may not assign or otherwise transfer, redistribute, encumber, sell, rent or lease any material, content or the like to another party; such and similar acts are completely against the Agreement. In the event that it is clear that any one of such actions has been performed by PARTICIPANT,
TÖMER reserves the right to terminate PARTICIPANT'S account without refund at its discretion and the term "PARTICIPANT" is cancelled. Subsequently,
TÖMER cancels access through user name and password to any or all services provided by UTOM.

TÖMER undertakes that PARTICIPANT will have an access to lesson content through the Internet and will be able to reach UTOM instructors by means of e-mail in order to present problems and receive replies. All expenses required to have an access to the Internet in order to be able to attend COURSES will be provided by PARTICIPANT.
TÖMER does not warrant an access to the Internet and cannot be held responsible for any problem to arise from a failure to connect to the Internet.

TÖMER does not warrant that PARTICIPANT who has registered for UTOM and participated COURSE will learn Turkish language.

At the end of each LEVEL, PARTICIPANT will receive a PARTICIPANT DOCUMENT to document that PARTICIPANT has registered for and participated in the related LEVEL, as well as to display PARTICIPANT's level of accomplishment. PARTICIPANT who has had a right to obtain a PARTICIPATION DOCUMENT and who has taken and received a pass mark at the CERTIFICATE test for the related LEVEL either in one of TOMER branches in Turkey or in a testing center in a country other than Turkey will have the right to demand a CERTIFICATE. Any PARTICIPANT who passes the test will receive a CERTIFICATE certified by TOMER. Provided that PARTICIPANT has completed all LEVELs over the Internet, PARTICIPANT may take the DIPLOMA test. DIPLOMA tests are given in TOMER branches in Turkey only.

TÖMER may not be held responsible for any direct and/or indirect damage to arise from the use or misuse or faulty use of COURSE materials for any reason during COURSE period.

Any information obtained by each party within the framework of the Agreement will be deemed as confidential; both parties are liable to keep any such information they may have obtained as confidential for an unlimited period of time. PARTICIPANT's name, address, telephone numbers, e-mail addresses and personal information are "confidential information" and
TÖMER warrants that no such information will be given to third party individuals and/or institutions. 
TÖMER reserves the right to make changes or adaptations in the already defined level system.

This Agreement abides by Laws of Turkish Republic. Unless otherwise agreed in writing, all disputes relating to this Agreement shall be subject to final and binding arbitration in Law Courts in Ankara, with the losing party paying all costs of arbitration.
